Omaxe told to pay Rs 25,000 to Ambala man for mental agony
MOHALI: The Mohali District Consumer Disputes Redressal Forum has directed real-estate firm Omaxe to refund Rs 1.26 lakh and compensate Rs 25,000 to an Ambala man who bought an under-construction flat from it in May 2007.
It has been asked to pay the Rs 25,000 as compensation for mental agony and harassment and as cost of litigation paid by the complainant. Dr Abhinav Jindal, in his complaint, claimed that he struck a deal of Rs 17 lakh for the flat with Omaxe and, as per the plan chosen by him, the payment was to be made as construction proceeded.
In the agreement, he claimed, the construction was to be completed in 30 months, or by February 2010, subject to further extension of 6 months. As assured by Omaxe, the complainant continued to pay the installments.
Jindal claimed that Omaxe had without his consent increased the price of the flat by Rs 1. 26 lakh.
He also claimed that the flat’s construction had not been completed and he kept reminding Omaxe about the delay. Later, Jindal said, Omaxe agreed to hand him over the flat in a month if he paid the balance amount.
However, according to him, though he paid the amount, the flat was not handed over to him and later Omaxe imposed a fine on him as he had not registered the flat in his name.
Jindal claimed that following this he approached Omaxe, which stated that it would waive off the fine if Jindal did not demand possession till completion of the project. Omaxe, on the other hand, said construction had always been ahead of the scheduled target. After hearing all arguments, the court passed orders in favour of the complainant.
