Consumer forum slaps Rs 1 lakh fine on Bilaspur builder
BILASPUR: District consumer forum has slapped a fine of Rs 1 lakh on a bilaspur builder who had, after entering into a contract and receiving an advance, did not get the registry done in favour of customer. Forum has also directed the builder to pay back the advance amount of Rs 5.90 lakh along with an interest of 12%.
Krishna Kumar Sharma, resident of Sipat Road, Sarkanda, had entered into a contract of purchasing a land plot measuring 2,000 square feet from Pavan Agrawal, director of Krishna Builders in his colony Krishna Vihar on December 10, 2012. As per the contract, Sharma paid Rs 4 lakh in advance and was promised that he would get the land registry within six months.
Moreover, as per the contract, Sharma paid Pavan Agrawal Rs 1,25,000 on March 15, 2013, Rs 2,25,000 on August 17, 2013 and Rs 2,40,000 on July 20, 2014. Thus, even after receiving Rs 5.90 lakh from Sharma, Pavan Agrawal began delaying getting the registry of the land done on behalf of the former. Sharma then got a legal notice served to Agrawal. Pavan Agrawal neither replied to the notice nor got the registry done on Sharma’s behalf. Eventually, after three years Sharma filed a petition against Pavan Agrawal before the district consumer forum. Sharma also ignored repeated notices by the district consumer forum.
Forum president Ashok Kumar Pathak and members Pramod Verma and Rita Barsaiyan, in their order, directed Agrawal to return Rs 5.90 lakh that he had received as advance from Sharma along with 12% interest from November 5, 2015 within a month to the petitioner. Besides, Agrawal has also been ordered to pay Rs 1 lakh as compensation for mental harassment and Rs 3,000 as case expenses to the petitioner.
