Chandigarh’s realty firm Silver City asked to pay Rs 27 lakh for service deficieny
CHANDIGARH: The State Consumer Disputes Redressal Forum has directed a real estate company to refund Rs 24.36 lakh and pay Rs 3 lakh as compensation to a city resident for delay in possession of a flat.
Gurpreet Singh, the complainant, booked a flat with Silver City Housing and Infrastructure Housing in its upcoming project “Silver City Housing” at Bhankarpur village in Derabassi. He paid an amount of Rs 1 lakh towards booking on August 1 and Rs 3.88 lakh later.
It was stated that the builder never had the requisite approvals at the time of accepting the booking amount. The flat was allotted to the complainant in Silver City Housing and Infrastructure Housing, measuring with car parking on March 23, 2012.
Singh alleged the builder with the intention to delay possession of the flat, further delayed execution of the agreement to sell, which was executed on July 12, 2012, and total amount of the flat was fixed for 31.75 lakh and the last instalment was payable at the time of possession, March 30, 2013. Singh availed loan of Rs 27 lakh repayable in 219 instalments at floating rate of interest from ICICI Bank, Chandigarh and a tripartite agreement dated June 24, 2013, was executed.
Singh paid Rs 14.28 lakh to the builder and another Rs 51,000 plus service, making it total amount of Rs 24.36 lakh.
Singh made various enquiries by visiting project site from time to time but the project was delayed as the brick work has not been completed. He also sent an email to Silver City Housing and Infrastructure Housing for explanation as to delay.
Sing had paid Rs 5.27 lakh to ICICI Bank towards interest on the loan amount alone besides the principal repayment amounting to Rs 96,000.
After hearing all the arguments, the court directed Silver City Housing and Infrastructure Housing to refund the amount of Rs 24.36 lakh with interest and Rs 3 lakh as compensation for mental agony and physical harassment, and Rs 50,000 as cost of litigation.
